Furthermore, "website" or "online shop" refers to the internet presence at http://www.mikkas-dollhouse.com/.

Scope

The following terms and conditions are applicable to any business relationship between the seller and the customer (website user) that arises from orders made by the customer through the online shop. The terms and conditions apply in the version valid at the time of ordering.

Contract conclusion

The presentation of goods on the website does not yet constitute a binding offer, but merely serves as a non-commital online catalogue.

Contracts between the seller and the customer are concluded as follows:

The customer chooses available items out of the assortment presented on the website and puts them into the so-called shopping cart. They can view the contents of the shopping cart, change quantities and remove previously added items at any time before confirmation of the order.

After clicking the button "Go to checkout" in the shopping cart, the customer is asked to register and log in, unless they have already done so. After successful login, the website guides the customer in three steps through the ordering process which they can abort anytime.

In the first two steps, the customer is asked to pick a method of payment and a shipment method. In step 3, they have the opportunity to review their personal data and the specifics of their order.

By clicking the button "Submit order", they submit a binding request to buy the contents of the shopping cart to the conditions listed.

An automated order confirmation is sent immediately after submission of the order. The contract is concluded with this order confirmation or delivery of the goods.

Should the customer receive neither order confirmation nor goods within two weeks, they are no longer bound to their order.

In the case that the customer doesn't make payment (of the due amount in full or of agreed-on partial payments) within two weeks after order confirmation, Mikka's Dollhouse is no longer bound to the order.

Non-deliverable goods

Should Mikka's Dollhouse learn of the non-deliverability (by the manufacturer) of an item after acceptance of an order that includes said item, the customer will be informed immediately. If payments have already been made for this item, they will be refunded in full and including shipping costs.

In this case, Mikka's Dollhouse reserves the right to withdraw from the contract due to it being unfulfillable.

Prices

All prices quoted on the website are end prices excluding shipping costs. Due to the VAT exemption for small business owners (according to § 19 Abs. 1 UStg), prices don't include VAT, and VAT isn't listed separately on the invoice.

Shipping costs

Shipping costs depend on quantity and weight of the ordered goods, as well as shipment method. In the course of the ordering process, all shipping costs are stated clearly before the customer submits their binding order.

Methods of payment

Two payment methods (bank transfer and Paypal) are offered according to the following conditions:

* Customers who order from Germany may pay via bank transfer to the account listed in the legal notice as well as the order confirmation.

* Customers who order from other EU countries belonging to the Eurozone (beside Germany) may choose between bank transfer or Paypal payment.

* Customers from all other European countries may pay through Paypal only.

Reservation of proprietary rights

All delivered goods will remain the property of Mikka's Dollhouse until they are paid for in full (including shipping costs).

Shipment and dispatch times


At this time, Mikka's Dollhouse reserves the right to ship to European countries only.

For the purposes of these terms, the dispatch time is defined as the time between receipt of the payment (of the due amount in full or the last agreed-on partial payment) by Mikka's Dollhouse and dispatch of the ordered goods to the shipment service charged with delivery.

The dispatch time is listed clearly in the description of each deliverable item on the website.


Revocation instruction

The customer can revoke the contract within two weeks without further specification of reasons. The revocation must be effected in writing (e.g. letter, fax, email) or -- if the goods have already been delivered -- by return of the goods. The respite starts with reception of this instruction in textual form at the earliest, but not before the customer has received the goods.

The timely dispatch of the letter of revocation or the goods is sufficient to keep the term. The revocation is to be addressed to:

Consequences of revocation

In case of an effective revocation, the benefits received on both sides have to be returned, including possible profits (e.g. interest).
If the customer cannot return the received goods or benefits, or cannot return them in full or only in diminished quality or value, they are required to make compensation for the difference.

This does not apply to diminishment of value that is caused exclusively by examination or testing of the goods as it would have been possible in a store. Apart from that, the customer can avoid any obligation for compensation by not using the goods like you would property and refraining from any usage that would diminish the value of the goods.

Packageable goods are to be returned at the risk of Mikka's Dollhouse. The customer has to pay the costs for the return shipment if the goods delivered correspond to the goods ordered and the value of the goods to be returned doesn't exceed 40 EUR or, if the value does exceed that limit, if the customer hasn't made payment or a partial payment agreed on in the contract. Otherwise the return shipment is without charge for the customer. Non-packable goods will be fetched from the customer.

Obligations to refund payments need to be fulfilled within 30 days. For the customer, the respite begins with dispatch of their letter of revocation or the goods. For the seller, the respite begins with their receipt.

The right to revoke doesn't apply to goods that have been manufactured to the customer's specifications, have clearly been tailored to their personal needs or aren't suitable for return due to their condition and make, and also not to goods that aren't usually part of the offered range but have been ordered for the customer specifically.

Pictures

The pictures added to the descriptions of the goods are examples and do not necessarily depict the exact item that you will receive. Hand-made items in particular can show slight variations, e.g. in painting. Also, the representation of colors and sizes can vary with the useage of different screens. The description of the item is the definitive factor.
